Imagine pushing a trash can down the street, then being investigated and arrested for what’s inside the trash can. In Ontario, California a woman was arrested because she was pushing a trash can down a street that contained remains of a human body. 51 year old Carmen Montenegro was pushing a trash can that smelled so terrible, it caused people to call the authorities. When authorities looked inside the trash can they discovered the remains of a man. Investigators are looking into who the remains are, what happened, and how it happened. Montenegro is in need of a great criminal defense attorney before charges are filed. If she hires a criminal defense lawyer right away, she will have strong partners who will defend and fight for her. She is in the Pre-file investigation stage of the criminal process. Millions of people throw out garbage everyday and it could have been anyone who placed the remains in that specific trash can. The first intent is to think that the trash can is filled with trash and not human remains. A criminal defense attorney is aware that these accusations can be taken out of context without explanation. That is why a criminal lawyer is necessary to show her side of the story in order to prevent charges from being filed. Criminal defense lawyers will come together and think of a game plan that will prevent charges from being filed.

Sex crime allegations are some of the most dangerous accusations that you can face in your life. As a sex crimes attorney will tell you, child pornography, rape, or molestation charges can have harsher consequences than being convicted of manslaughter. Sex crimes, especially sex crimes involving children, are regarded at the level of the most sadistic crimes that can be committed. The public constantly challenges law enforcement officials and legislators to be tougher on convicted sex crime felons, stating that too many sexual predators roam our streets and endanger our children. In 2006, President Bush signed the John Walsh Act which controversially gives federal officials the power to indefinitely hold federal inmates that are considered “sexually dangerous” after their prison terms are complete. Federal criminal attorneys have challenged this act on behalf of four men convicted of sex crimes with completed prison terms for charges such as sexual abuse of a minor and child pornography. On Monday, the Supreme Court ruled that the Federal Government is within its’ right to indefinitely detain federal inmates who pose a high risk of recidivistic behavior, or of becoming a repeat sex offender.

The power of Congress to commit “sexually dangerous” inmates was compared by Supreme Court Justice Nominee Elena Kagan to the power of Congress to indefinitely hold federal inmates whose sentences have expired but that have highly contagious or deadly diseases. Do certain inmates deserve to be incarcerated at the discretion of the Federal Government in order to protect the general public from disease or sexual attack? These acts make inmates who are convicted of sex crimes or who are extremely ill the pariahs of society and borders on inhumane incarceration.

The Supreme Court ruling in favor of the John Walsh act is extremely terrifying and harsh. If accused of a sex crime what should you do? Run away to a foreign country; resign yourself to a life in prison? NO! You should contact a criminal defense attorney immediately as soon as sex crime allegations are made or a police investigation begins against you. The best time for a criminal lawyer to become involved is during the pre-file stage, before formal charges of rape, molestation, or sexual assault are pressed and prosecution proceeds in a court of law. A molestation attorney during the pre-file can act as a buffer between you and the police investigators and fight to dismiss any child pornography or sexual assault accusation against you before they turn into formal criminal charges. If confronted with the quotidian confinement of a federal prison for the rest of your life, wouldn’t you want the best criminal defense lawyer to represent you and fight for any allegations or sex crimes charges to be dismissed as quickly as possible? The government, law enforcement, and the general public do not deal lightly with people convicted of sex crimes. A criminal defense lawyer is your only ticket to insure that your right to liberty will not be taken away.

Everyone likes to break a record, heck, some people spend their whole lives growing out their fingernails or making the world’s largest pancake just to be in the Guinness Book of World Records. Other records should not be broken. A Pennsylvania third grader has put in a bid for America’s youngest drug dealer, allegedly dolling out little packets of heroin to his pals at school. The packets ironically had the words “trust me” stamped on them since nothing is more suspicious than an unidentified, white powder with possible hallucinogenic or poisonous qualities. At what age does a minor become aware of the illegality and the criminal nature of their actions, and at what age does a child deserve to be punished regardless of whether they knew they were committing a crime or not? A teenager handing out heroin at school would be busted with a long list of drug charges including possession of a controlled substance with intent to distribute, or with the amount of heroin this 3rd grader had on him, charges of drug trafficking. Will this youngster need a criminal defense attorney to keep his record clean or will the courts find that this child was innocently unaware of what he/she was doing and has been caught in the middle of someone else’s scheme?

No charges have been filed against the child yet and a good juvenile defense lawyer will disprove any criminal intent of the child and stop any allegations before they turn into formal criminal drug charges. To begin with, the kid wasn’t selling the heroin. He was just passing it around like candy. He obviously had very little idea of the value of what he held in his little hands, which allegedly was worth about $1,000! A juvenile drug attorney would argue that this child should not be charged or sentenced because he had no knowledge that what he was doing was wrong, he did not pass out the heroin for personal gain, and because he did not harm any of his classmates with his little party favors.

So if the child isn’t responsible for this incident, who is? Perhaps it was some drug dealer’s sadistic idea to enlarge their client base by addicting third graders to heroin? More likely, this child found and took something that wasn’t theirs and he/she is going to be in a lot of trouble at home. It is very probable that it will be the parents of the child who are going to take the fall for this and will need to hire a criminal defense attorney to protect them against charges of child neglect, child abuse, drug possession, and distribution of a controlled substance. The parents at the school where this incident occurred are going to want someone to blame, and the school officials are going to want to push the blame as far away from themselves as possible. So when the cops knock on the door, the parents of this child better be ready with a criminal defense lawyer by their side to make sure that they do not incriminate themselves while they are under investigation. If they do not seek the help of a criminal defense lawyer from the beginning they could be facing serious consequences including being charged with heroin possession and having custody of their child taken away. Let’s hope that this family’s criminal defense attorney can show that it was all just one big mistake and the next time that this child brings something to share at school, it is brownies, and I don’t mean the magical kind.

Most of us can recall the famous news story of the boy that was supposedly trapped in a balloon. We watched the news anxiously wanting to know the fate of the boy trapped in the enormous balloon that was flying across Colorado. It was natural to feel concerned for the boy’s well being and empathize with the boy’s parents. Until, it was discovered that it was all a hoax and the parents had filed a false police report.

Mayumi and Richard Heene, the parents of the famous balloon boy, allegedly claimed that their son floated in a homemade balloon on October 15, 2009. The balloon flew about fifty miles before it landed near a Denver airport where the coast guard was sent to retrieve the boy that supposedly was carried away by the balloon. To everyone’s surprise, the boy was not inside the balloon or nowhere near it. A manhunt around the area began searching for the missing boy. Later that day the boy was found hiding in his home.

After the incident many suspected the incident was a hoax and an investigation took place. During the investigation it was found that both of the parent’s stories did not coincide, which implicated that they were both lying. According to The Associated Press, Mrs. Heene made a statement to the authorities acknowledging that the incident was all a hoax. Mrs. Heene allegedly said that they were facing economic hardship and thought that this incident would provide the resources they needed to obtain money.

The mother, Mayumi Heene, was charged with filing a false report and her husband, Richard Heene, with attempting to influence a public servant. Even though Mr. Heene has stated that he really thought his son was in the balloon, he only pleaded guilty to prevent his wife from being deported to Japan according to The Associated Press. They were both found guilty and will be facing up to thirty days in jail

The Heene’s could have saved themselves a lot of trouble if they had obtained a skilled criminal attorney immediately after an investigation was set in motion. With a criminal attorney during the investigation phase of the case, the Heene’s could have avoided making statements on their own behalf. Their criminal attorney could have protected them from making any incriminating statements, as well as protected Mrs. Heene’s immigration status from being an issue in the case. It’s very sad what this family had to do to obtain some attention and a chance to make some money. These are very hard times and it’s understandable what people are willing to do for the sake of providing some food and shelter to their families. It is never okay commit a crime. However, a skilled criminal defense attorney will ensure that you have a fair chance in court when you are being prosecuted.

http://www.cnn.com/2009/US/10/18/colorado.balloon.investigation/index.html

You would think that David Copperfield, the world famous magician would be able to make anything disappear, even rape charges. David Copperfield for the last two years has been under criminal investigation for allegedly sexually assaulting a 23-year-old fashion model in his private island. Copperfield allegedly invited the accuser to his island after meeting her at one of his shows, where he pulled her out of the crowd during one of his performances. According to the accuser, Copperfield performed numerous methods of torture to pressure her into becoming sexually active with him.

The case investigation has been closed and Copperfield will not be facing any sexual assault charges. The investigation was closed due to a recent case where Copperfield’s accuser has been found guilty of lying to the authorities and making a false accusation of sexual assault against another man. The accuser was found guilty after video evidence showed her voluntarily entering a man’s hotel room and his accusation of her attempting to prostitute herself to him.
Copperfield’s criminal attorneys were able to use the accuser’s character statement from her recent case to show her untrustworthy character. Without the aid and intervention of Copperfield’s criminal lawyers, the false statements that show the accusers unreliable character would have probably been ignored and Mr. Copperfield might have faced sexual assault charges that would have damaged his career and life. Mr. Copperfield’s sex crime lawyers also probably helped him by preventing him from providing the authorities with statements that could have been manipulated to depict him as a guilty man and jeopardized the credibility to his case.

The work that Mr. Copperfield’s criminal lawyers provided him was during the pre-file stage of his investigation. Before a person is charged with a crime an investigation has to first take place. During the investigation phase sexual assault attorneys can work as a shield to prevent the client from making statements that jeopardize their case or provide information/evidence that shows the client’s innocence. Mr. Copperfield made the best decision by involving his criminal defense firm immediately before any charges were filed. He has saved himself the public humiliation of going to jail and being seen as a sexual predator, and most importantly the money that would have cost to go to trial to defend his innocence.

Tiger Woods, the number one golfer in the world, has been the main topic of conversation in the news, entertainment and public. The intense attention placed on Woods this month did not develop because of his excellent golfing career, but because of his personal life and potential criminal charges that he may be facing. Tiger needed a criminal defense attorney, fast! Woods’ is suspected of driving under the influence after hitting a hydrant and a tree with his SUV. Drunk driving is a serious crime and although Tiger may have avoided this DUI charge for now, even a celebrity can be charged with DUI. (For those who don’t remember, Kiefer Sutherland received a 42 day jail sentence for his 3rd drunk driving charge quite recently). Back to Tiger; his wife, Elin, rescued Woods by breaking the back windows of the Cadillac Escalade. Luckily, Woods did not endure major injuries, and was taken to the hospital shortly after the incident. It is speculated that Woods’ accident was influenced by a dispute with his wife after she allegedly confronted Woods about his affairs with other women. There don’t seem to be any allegations of domestic violence at this time.

Woods was suspected of being under the influence of alcohol and prescribed drugs during the incident. He was not charged with any criminal charges due to the lack of evidence, but was cited for careless driving and fined $164. Woods was ultimately saved from having a drunk driving charge being filed against him by making the immediate decision to protect himself by hiring the services of his criminal attorney before ever submitting a statement to the authorities.

The process that possibly saved Tiger Woods from facing criminal charges is what we call a Pre-file. In order for someone to be charged with a crime, some kind of investigation has to take place. During the investigation phase, a criminal defense attorney can get involved and prevent any charges from being filed by working with investigators to ensure the accused does not make any statements that may be used against him/her. Woods’ hesitation to speak to the authorities and the involvement of his criminal defense attorney reduced his risk of facing any DUI charges or any other criminal charges that could have had vast damage on his career.

For more information on pre-file investigations you can visit our site at: http://www.criminalattorneyusa.com/pre-file-investigation.aspx
