The power of Congress to commit “sexually dangerous” inmates was compared by Supreme Court Justice Nominee Elena Kagan to the power of Congress to indefinitely hold federal inmates whose sentences have expired but that have highly contagious or deadly diseases. Mayumi and Richard Heene, the parents of the famous balloon boy, allegedly claimed that their son floated in a homemade balloon on October 15, 2009. The balloon flew about fifty miles before it landed near a Denver airport where the coast guard was sent to retrieve the boy that supposedly was carried away by the balloon. To everyone’s surprise, the boy was not inside the balloon or nowhere near it. A manhunt around the area began searching for the missing boy. Later that day the boy was found hiding in his home.

After the incident many suspected the incident was a hoax and an investigation took place. During the investigation it was found that both of the parent’s stories did not coincide, which implicated that they were both lying. According to The Associated Press, Mrs. Heene made a statement to the authorities acknowledging that the incident was all a hoax. Mrs. Heene allegedly said that they were facing economic hardship and thought that this incident would provide the resources they needed to obtain money.

The mother, Mayumi Heene, was charged with filing a false report and her husband, Richard Heene, with attempting to influence a public servant. Even though Mr. Heene has stated that he really thought his son was in the balloon, he only pleaded guilty to prevent his wife from being deported to Japan according to The Associated Press. They were both found guilty and will be facing up to thirty days in jail

The Heene’s could have saved themselves a lot of trouble if they had obtained a skilled criminal attorney immediately after an investigation was set in motion.
