Being accused of soliciting sex to a minor is one of the most serious charges you can face in your life. In Connersville Indiana, the authorities arrested a man who thought was meeting a 12 year old girl to have sex. Police say this man showed up in a horse and buggy. An unknown number text messaged a girl. When the girl didn’t know who the number was, she gave the phone to her mother. Police say 26 year old Willard Yoder was using his cell phone to ask a 12 year old for sex and naked pictures of her. He is being charged with four counts of child solicitation. This seems like a hard case to defend because Yoder is accused of sending over 600 texts to this 12 year old girl. These texts include nude videos and pictures. Yoder even sent naked pictures of himself. Skillful criminal defense attorneys have to come together and diligently pursue the best outcome for Willard. There is a lot of evidence that proves he committed the crime. Perhaps a plea deal would bring the best outcome for Willard. If he hires a criminal defense lawyer right away, he will have strong partners who will defend and fight for him and possibly attain him a favorable plea bargain. Whatever Willard decides to do, it is clear his criminal defense lawyers will have a lot on their hands! Tough one.

Sex crime allegations are some of the most dangerous accusations that you can face in your life. As a sex crimes attorney will tell you, child pornography, rape, or molestation charges can have harsher consequences than being convicted of manslaughter. Sex crimes, especially sex crimes involving children, are regarded at the level of the most sadistic crimes that can be committed. The public constantly challenges law enforcement officials and legislators to be tougher on convicted sex crime felons, stating that too many sexual predators roam our streets and endanger our children. In 2006, President Bush signed the John Walsh Act which controversially gives federal officials the power to indefinitely hold federal inmates that are considered “sexually dangerous” after their prison terms are complete. Federal criminal attorneys have challenged this act on behalf of four men convicted of sex crimes with completed prison terms for charges such as sexual abuse of a minor and child pornography. On Monday, the Supreme Court ruled that the Federal Government is within its’ right to indefinitely detain federal inmates who pose a high risk of recidivistic behavior, or of becoming a repeat sex offender.

The power of Congress to commit “sexually dangerous” inmates was compared by Supreme Court Justice Nominee Elena Kagan to the power of Congress to indefinitely hold federal inmates whose sentences have expired but that have highly contagious or deadly diseases. Do certain inmates deserve to be incarcerated at the discretion of the Federal Government in order to protect the general public from disease or sexual attack? These acts make inmates who are convicted of sex crimes or who are extremely ill the pariahs of society and borders on inhumane incarceration.

The Supreme Court ruling in favor of the John Walsh act is extremely terrifying and harsh. If accused of a sex crime what should you do? Run away to a foreign country; resign yourself to a life in prison? NO! You should contact a criminal defense attorney immediately as soon as sex crime allegations are made or a police investigation begins against you. The best time for a criminal lawyer to become involved is during the pre-file stage, before formal charges of rape, molestation, or sexual assault are pressed and prosecution proceeds in a court of law. A molestation attorney during the pre-file can act as a buffer between you and the police investigators and fight to dismiss any child pornography or sexual assault accusation against you before they turn into formal criminal charges. If confronted with the quotidian confinement of a federal prison for the rest of your life, wouldn’t you want the best criminal defense lawyer to represent you and fight for any allegations or sex crimes charges to be dismissed as quickly as possible? The government, law enforcement, and the general public do not deal lightly with people convicted of sex crimes. A criminal defense lawyer is your only ticket to insure that your right to liberty will not be taken away.

What would have been Tonya Crafts fate if she had not been represented by an aggressive criminal defense attorney? She would have likely been convicted on charges of child molestation, sexual battery, and aggravated child molestation. She would have been possibly sentenced to life in prison. Instead, her molestation lawyer has undoubtedly proven her innocent and Crafts has been acquitted of all twenty-two counts against her. The trial has been a life-changing ordeal, and the task before Crafts now is to rebuild her life and her family. As a result of the child molestation and sexual assault allegations, Craft lost her job, custody of her daughters, and had to move to a different part of the state. At least due to the work of her criminal lawyer, she will not be wrongfully charged as a serial child molester and spend the rest of her life behind bars.

Craft, a kindergarten teacher in Georgia, was accused of sex crimes against two of her students and her own daughter. Allegation spun out of control and ended in a two year trial that concluded this week. Craft’s criminal defense attorney showed the jury that the child molestation charges against Craft were absolutely false and based on faulty evidence. The criminal lawyer uncovered the conflicting details of the alleged victims’ testimony and showed that the school parents had manipulated their children to falsely accuse Craft. Craft’s criminal defense attorney also argued that there was no proof that the three girls had been sexually abused, further negating the sex crimes charges against her.

Like many sex crime allegations, the child molestation and sexual assault charges against Craft were not true. If it hadn’t been for a skilled sex crimes lawyer, this mother would have permanently lost her children and would have possibly been convicted of a crime she did not commit. Imagine being a parent falsely accused of harming your own child. It would be a devastating experience that would make you lose all faith in the legal system. Thank goodness Craft’s criminal defense attorney was able to find justice.

Lawrence Taylor is going to need a great criminal defense lawyer if he wants to be remembered for being inducted into the Pro Football Hall of Fame instead of indicted for rape and solicitation of prostitution. Taylor has been formally charged with third-degree rape and patronizing prostitution. Unfortunately for Taylor, the alleged victim was one year under the legal the age of consent in New York, thus making his charges rape of a minor and solicitation of child prostitution. It appears that Taylor will plead not guilty and that the defense has a plan to prove Taylor’s innocence. The ultimate goal of Taylor’s criminal defense attorney would be to have all charges dropped. This is not Taylor’s first brush with the wrong side of the law and he was previously charged and convicted on two occasions of possessing drug paraphernalia and is also on federal probation for filing false tax returns and tax evasion. Luckily, New York does not enforce the three strikes law and consequently if Taylor’s sexual assault lawyer is unable to dismiss all charges against him, a good outcome may still be reached and Taylor may still be able to avoid serving any prison time.

The FBI is teaming up with police to combat underage prostitution in a national campaign called Innocence Lost. The goal of this program is to fight child prostitution by decriminalizing the girls involved and charging the people who control them and solicit prostitution instead. Even though many girls engaging in child prostitution make themselves available through internet ads, they are looked at as victims that need protecting from themselves and from the people that are taking advantage of them. It is likely that given this national crackdown on child prostitution, the prosecution will be extremely tough on Taylor due to the fact that the girl was underage, and will seek as harsh of penalties as possible for the rape charges and solicitation of prostitution charges. Currently there appears to be no evidence proving that Taylor sexually assaulted the alleged victim beyond a text she sent to her uncle after the alleged incident explaining what happened. Taylor’s criminal defense lawyer will have to show that there is no evidence to corroborate the alleged victim’s statements. The alleged victim could have made wild accusations due to emotional and psychological strain. The alleged victim was a runaway from her family, had been reported a missing person, and was allegedly staying with the man that brought her to Taylor’s hotel. This man appears to have beaten the alleged victim prior to the incident that occurred in Taylor’s room. Alleged victims of assault and domestic violence often make accusations that they later say are untrue and wish to recant in court. It is probable that the girl, who appears to have been abused by the man she was staying with, made statements against Taylor in the heat of the moment out of fear and emotional instability that will prove false in court. Instead of trying to incriminate Taylor, a well known public figure, the prosecution should go after the man who has most likely repeatedly beaten and forced the alleged victim into prostitution. Most importantly, the court needs to seek help for the alleged victim so that she can make more positive choices in her life and have a better future than one of prostitution, instability, and crime.

What do we do when legal offenses become normalized in society, when certain crimes are not considered illegal or “wrong” by a large portion of the population and are committed daily without thought of the consequences. Such I would argue is the case with illegal downloading and pirating of music, movies, and television. Lots of people do it, probably only a small percentage is ever fined, and many do not think of it as morally reprehensible. Such also appears to be the case with teen “sexting” or sending nude or semi-nude photographs or explicit messages by cell. In multiple studies, over twenty percent of teens surveyed admitted to sexting, although it seems likely that the percentage of teens that actually participate in this behavior is probably much greater.

What many teens may not understand is that sexting involving any underage individual can be considered child pornography. It is a felony to possess, receive, distribute, or produce child pornography, and if convicted can result in serious consequences including public registration as a sex offender. How many teenagers would be shocked to find that their everyday flirty and sometimes explicit texts can lead to felony charges? The normalization of sharing explicit images has certainly not been helped by the actions of teen icons. Naked photos of various teen stars have found their way to the internet and certain teen icons have repeatedly posted sexually suggestive photos on their twitter and MySpace pages.

In 2009, three high school girls who sent photos of themselves to three male classmates at a high school in Pennsylvania were charged with child pornography. They were forced to look into hiring sex crime attorneys. The male classmates who received the photos were also charged with child pornography and had to be defended by criminal defense lawyers. Recently, Philip Alpert of Florida has been convicted of child pornography and registered as a sex offender for sending a naked photo of his sixteen year old girlfriend to friends and family after an argument. At the time of the incident Philip had just turned 18 and described himself as an “immature kid.” Even if Philip had been underage, thirty eight states include juvenile offenders on their sex offender registries. Philip is currently fighting, with a criminal attorney on his side, to be removed from the registry and has to deal every day with the consequences of being identified as a sex offender including being expelled from college and being unable to find employment because of his criminal history.

Is Philip taking the fall for a crime that is committed by many teens every day? It seems that if stringent sentencing is going to be applied for sexting offenses, than much more education is necessary for school-age children to build awareness that what they are doing is a crime. Opponents of harsh penalties for sexting argue that the laws pertaining to the dissemination and possession of child pornography are not adequate to deal with this new technology and crime. While it is unclear what would be the best way to regulate sexting, what is clear is that sexting is not all fun and games. The problem is that while many teens may view sexting as an innocent activity, sexting has caused great harm. In one incident, a high-school age girl committed suicide after a mass sext was sent out to fellow students containing sexually explicit photos of her. What will be the final solution? A continuation of harsh penalties combined with awareness building, relaxation of existing laws, or regulation of camera phones for minors?

You would think that David Copperfield, the world famous magician would be able to make anything disappear, even rape charges. David Copperfield for the last two years has been under criminal investigation for allegedly sexually assaulting a 23-year-old fashion model in his private island. Copperfield allegedly invited the accuser to his island after meeting her at one of his shows, where he pulled her out of the crowd during one of his performances. According to the accuser, Copperfield performed numerous methods of torture to pressure her into becoming sexually active with him.

The case investigation has been closed and Copperfield will not be facing any sexual assault charges. The investigation was closed due to a recent case where Copperfield’s accuser has been found guilty of lying to the authorities and making a false accusation of sexual assault against another man. The accuser was found guilty after video evidence showed her voluntarily entering a man’s hotel room and his accusation of her attempting to prostitute herself to him.
Copperfield’s criminal attorneys were able to use the accuser’s character statement from her recent case to show her untrustworthy character. Without the aid and intervention of Copperfield’s criminal lawyers, the false statements that show the accusers unreliable character would have probably been ignored and Mr. Copperfield might have faced sexual assault charges that would have damaged his career and life. Mr. Copperfield’s sex crime lawyers also probably helped him by preventing him from providing the authorities with statements that could have been manipulated to depict him as a guilty man and jeopardized the credibility to his case.

The work that Mr. Copperfield’s criminal lawyers provided him was during the pre-file stage of his investigation. Before a person is charged with a crime an investigation has to first take place. During the investigation phase sexual assault attorneys can work as a shield to prevent the client from making statements that jeopardize their case or provide information/evidence that shows the client’s innocence. Mr. Copperfield made the best decision by involving his criminal defense firm immediately before any charges were filed. He has saved himself the public humiliation of going to jail and being seen as a sexual predator, and most importantly the money that would have cost to go to trial to defend his innocence.

A man in Bartow, Florida was exonerated from rape charges due to new evidence that was provided by the latest DNA testing. James Bain was charged with kidnapping, burglary and strong arm rape thirty five years ago. A 9 year old boy accused Bain of rape after identifying him as his rapist from a series of pictures shown to him by the police. The 9 year old boy was kidnapped and raped by an older man after being dragged out of his house where he was sleeping with his siblings.

Mr. Bain is currently ecstatic after finding out that he will be released from jail after spending thirty five years in prison. His main concern after being released is taking care of his handicapped mother. It is very disturbing that innocent people like James Bain, are charged and sentenced to a lifetime in prison where their life is wasted away. Thanks to states like Florida, who has passed a statute that allows the reopening of cases for DNA testing, people like Mr. Bain can finally get their life back. Criminal attorneys should look into such new statutes and up to date on all laws.

James Bain’s case is an example of why it is vital to obtain a criminal defense attorney when being accused of a sex crime. There are many methods of defending a person from sex crime charges, one method being DNA testing. The use of technology in the courtrooms has grown with the development of new scientific techniques that aid the precision of the criminal defense. A sex crime attorney can seek this new practice, as well investigate the history of the alleged victim which will strengthen one’s case and prevent further consequences. Without a criminal lawyer, you can be at risk of not understanding your options for defense and as a result face a fate similar to that of Mr. Bain’s.

The cost of education has recently gone up to a level that students do not feel safe paying. This cost is the physical risk involved in attending a college in America. There have been a string of violent crimes on-campus across American campuses in recent months. The latest statistics show there were more than 35,000 reported crimes on U.S. college campuses in just one year.

Last month, a UCLA student was assaulted, getting stabbed several times and slashed in the neck by her organic chemistry lab partner. While the suspect was not known for having any history of committing violent crimes, school officials and law enforcement authorities speculate that the crime was committed after the suspect had a break-down from the stress of the class. An organic chemistry TA noted that the lab portion of the class was extremely difficult, KTLA reported. It is unclear why the 20-year-old defendant, Thompson, who hired a criminal defense attorney, pled not guilty to the charge of attempted premeditated murder. Maybe it was heat of passion killing and they are aiming for lesser homicide charges like manslaughter.

As recent as this week, a hostage stand-off took place at a high school in upstate New York. A man brandishing a gun held the school principal hostage for approximately 2 hours before the stand-off ended without any injuries. The initial police reports indicated that the gunman was a parent of a student who was recently suspended by the principal. This is just another example that demonstrates just how dangerous our school campuses really are. Any crime on school campus is considered a serious crime now, more than ever. Because of the recent events that have unfolded on campuses, courts are prosecuting these crimes aggressively, and it is vital to have a criminal defense lawyer on your side to fight back and ensure you are not being taken advantage of.

Typical crimes that are reported to authorities on campus include purse-snatching in broad daylight, also known as theft or robbery, vandalism, car break-ins, also known as grand theft auto, and shoplifting at campus stores. But there are also cases of horrifying crimes committed on campus which include assault, molestation, rape, and in some extreme cases, murder.

Many school officials have acknowledged that more security measures should be in place, but they maintain that it is impossible to implement a crime prevention plan that is 100% effective. Some schools, however, insist they take adequate precautions to ensure their students’ safety, including the use of patrols and guards. Many criminal defense attorneys agree with this.

There does not seem to be an ideal model for security and safety on school campuses across America. Perhaps, over time, school officials, government legislators and the general public will finally sit down to implement a system that is both effective and efficient.

Roman Polanski’s recent arrest in Zurich, Switzerland and pending extradition to the United States serve as a reminder to all criminal offenders that the long arm of the law has no bounds in today’s society.

Polanski is perhaps one of the greatest contemporary film directors of his time. His works have received a number of awards and even more nominations. In 1977, after originally being charged with raping a 13-year-old and several other crimes, Polanski pled guilty to a lesser charge of unlawful sexual intercourse with a minor. It is the behind-closed-doors bargaining between the criminal defense attorneys and the state prosecutor that undoubtedly led to this plea.

Following the plea, Polanski fled the United States in response to the threat of imprisonment. He moved to France where he lived until his arrest. Polanski was arrested while on his way to the Zurich Film Festival to receive a lifetime achievement award. The arrest is consistent with International extradition laws between Switzerland and the United States.

Polanski’s criminal defense lawyers have worked locally in California to clear Polanski’s record, which includes an arrest warrant that has been standing for over 30 years. Further, these sex crime attorneys are in the midst of fighting the current extradition request by American authorities. There have been both public attention and controversy surrounding the case due to Polanski’s fame as well as potential misconduct. It will be very interesting to see how the extradition and subsequent judicial proceedings unfold as time goes on.

This case raises a fundamental concern that legal professionals face while working in criminal defense – the struggle between personal moral beliefs and the ethical responsibilities owed to their clients. Criminal lawyers, or sex crime lawyers are constantly faced with the task of setting aside or questioning core beliefs while defending potential criminal offenders. While it is mandated that an attorney work objectively towards proving their clients innocence, the nature and circumstances surrounding the crime and victim often prove to be very gruesome and difficult to handle.

For these reasons, the criminal defense of accused sexual criminals has become an area of law that is not as attractive to new associates coming out of law school. The unwillingness of new criminal defense attorneys wanting to question their moral foundations has thus raised the premium for those who are. At Terani Law Firm, you will find fair, objective, hardworking criminal defense lawyers who have extensive experience in defending individuals facing criminal charges for all sex crimes.
