People would like to believe that human beings know right from wrong naturally, and outside forces do not impact our capability to know the difference. That can be true for some cases but be false in others. Every situation is different. In southern California, a teen driven by white supremacist beliefs murdered one of his classmates at his high school because he was gay. The teen murdered his gay classmate by firing two gunshots to the back of his head. The district attorney says the teen defendant took action because of his white supremacist ideology that homosexuality is wrong. Richard fatally shot three police officers and injured two others. He is described as a man who is enthusiastic, easy going, and a fun loving guy. Six teenagers in New York City have been charged with murder and the reason behind their actions is hate. The teenagers decided to assault and murder a man because he appeared to be homosexual.  Authorities indicted these teenagers with 21 counts including second degree murder as a hate crime. According to witnesses, the teenagers beat and stomped the 18 year old until he was dead.  It will be tough for <a href="http://www.criminalattorneyusa.com/" rel="nofollow" >criminal defense attorneys</a> to defend this case.  Hate crimes are taken very seriously because it is a crime that clearly shows the intent behind the action.  The <a href="http://www.criminalattorneyusa.com/criminal-defense-lawyers.aspx" rel="nofollow" >criminal defense lawyers</a> needs to prove to the court that the murder did not happen because the individuals have hate towards homosexuals.  Any criminal defense lawyer taking on this case would have a hell of a time putting together a strong defense. When authorities looked inside the trash can they discovered the remains of a man. Investigators are looking into who the remains are, what happened, and how it happened. 			<content:encoded><![CDATA[<p>Criminal justice is about intent and result.  If you kill a person, the punishment depends on whether the act was premeditated, spontaneous, or self-defense.  If you are caught <a href="http://www.criminalattorneyusa.com/drug-sales-defense.aspx" rel="nofollow" >selling drugs</a>, it matters if you are a <a href="http://www.criminalattorneyusa.com/juvenile-criminal-lawyer.aspx" rel="nofollow" >juvenile</a> or an adult and are perceived by the court to understand the full consequences and meanings of your actions.  In our criminal justice system it is the role of the criminal defense lawyer to show the court the intention behind the crime and seek an appropriate consequence for the crime committed.  It is said that many crimes are motivated by greed, jealousy, or lust.  However, human motivation is not always so simple, or so malevolent. In many cases, a <a href="http://www.criminalattorneyusa.com/criminal-defense-lawyers.aspx" rel="nofollow" >criminal lawyer</a> is able to explain the mitigating circumstances such as need, addiction, or depression that causes a person to commit a crime.  For example a father does not steal baby formula because he is greedy, but because he desperately needs to feed his child. </p>
<p>However, certain crimes are so heinous that it is difficult to conceive of any justification or imagine the motivation behind the crime.  For example, what causes a person to mark a mentally disabled man with degrading symbols, drag a black man behind a truck until all remnants of life have been torn from his body, or beat a South American immigrant to death because it appeared that he was gay?  <a href="http://www.criminalattorneyusa.com/hate-crime.aspx" rel="nofollow" >Hate crimes</a> are a special class of criminal charges differentiated by the intention behind the crime.  A hate crime is a crime motivated by bias towards ethnicity, race, religion, sexual orientation, or disability. <a href="http://www.criminalattorneyusa.com/hate-crime.aspx" rel="nofollow"  target="_blank"> Hate crimes are often punished by a harsher sentence</a> than the same criminal action not motivated by these biases. Hate crime cases are extremely tough for even the best criminal defense attorneys and can carry a punishment up to life in prison or the death penalty depending on the severity of the crime. </p>
<p>For example, in a recent case three <a href="http://www.criminalattorneyusa.com/new-mexico/" rel="nofollow" >New Mexico</a> men have been accused of kidnapping, branding a swastika, cutting a swastika into the hair, and writing degrading messages all over a mentally challenged man from the Navajo reservation.  The men have been charged with kidnapping, <a href="http://www.criminalattorneyusa.com/assault-battery.aspx" rel="nofollow" >aggravated battery</a>, and causing great bodily harm.  They are already facing felony charges, but prosecutors are also going to fight aggressively for these men to be charged with a <a href="http://www.criminalattorneyusa.com/hate-crime.aspx" rel="nofollow" >hate crime</a>.  If convicted of a hate crime, <a href="http://www.criminalattorneyusa.com/new-mexico/" rel="nofollow" >New Mexico</a> law mandates that one year will be added to the sentence for each charge that they are convicted of.  The alleged perpetrators could receive up to thirty-five years in prison, including eighteen years of incarceration without consideration for parole.   These men will need an experienced <a href="http://www.criminalattorneyusa.com/" rel="nofollow" >criminal attorney</a> to repudiate the hate crime allegations or they could be spending more than a third of their life in prison.   </p>
<p>Is this case a <a href="http://www.criminalattorneyusa.com/hate-crime.aspx" rel="nofollow" >hate crime</a>?  The most grievous allegation against the three men is that they allegedly branded a swastika on the mentally disabled man’s arm using a heated metal clothes hanger.  However, branding itself is not always a crime, much less a hate crime.  A man was recently acquitted of two counts of branding his children in Washington State.  Once again it is all about intent.  The Washington man was acquitted of the assault charges against his children because his criminal defense attorney proved to the court that the branding was not done out of anger or cruelty but was a manner in which the family bonded and demonstrated family unity.  However, given the historic symbolism of the swastika, the ethnic background, and mental disability of the victim, it is unlikely that even a skilled criminal lawyer will be able to dismiss all charges against these men.  The <a href="http://www.criminalattorneyusa.com/criminal-defense-lawyers.aspx" rel="nofollow" >criminal defense lawyer</a> on this case will have a challenge to even rebuff the hate crime enhancement to the kidnapping and <a href="http://www.criminalattorneyusa.com/assault-battery.aspx" rel="nofollow" >assault</a> charges.  During a search following the alleged incident, police found insignia associated with white supremacists, which is one of the foremost groups to be charged with hate crimes.  The best course of action for these men and their criminal defense lawyer could be to negotiate a plea deal since a jury is most likely going to be very unsympathetic towards men with white supremacist sympathies that branded a Nazi associated symbol on a disabled man that could not defend himself.   </p>

Scientists believe that the higher testosterone levels in this particular group of lions makes them more aggressive and territorial than any other pride.  In sharks, species with the highest testosterone levels are the most aggressive sharks in the ocean, more aggressive even than the great white.  Testosterone levels between species vary but testosterone levels between individuals of the same species, including humans, also vary.  Are some men naturally predisposed to violence and incapacitated by their chemical makeup when it comes to controlling their anger and aggression?  Are certain men in greater danger of becoming involved in a domestic dispute and being charged with <a href="http://www.criminalattorneyusa.com/domestic-violence-lawyers.aspx" rel="nofollow" >domestic violence</a>?  Do the men represented by domestic violence attorneys have higher testosterone levels than other men who were never charged with spousal battery?  While these questions of yet have no concrete answers, a recent domestic violence case shows that there could be some validity to the hypothesis that men charged with domestic violence could suffer from above average testosterone levels. </p>

			<content:encoded><![CDATA[<p>How would you like your transgression to be viewed by millions of people on the web?  Former <a href="http://www.criminalattorneyusa.com/new-york/" rel="nofollow" >NYPD</a> officer Patrick Pogan, who is accused of assaulting cyclist Christopher Long during a Critical Mass ride, has to face being a YouTube sensation every day.  In a video that has been viewed over two million times, the infamous officer appears to slam Long off his bike for no reason that is apparent to the viewer.  Pogan faces up to four years of prison time if convicted of charges against him including <a href="http://www.criminalattorneyusa.com/assault-battery.aspx" rel="nofollow" >assault</a> and falsifying a report.  His <a href="http://www.criminalattorneyusa.com/criminal-defense-lawyers.aspx" rel="nofollow" >criminal defense lawyer</a> will have to prove that Pogan had reason to forcefully detain the cyclist and that he did not intentionally change his story in his initial police reports of the incident to falsely incriminate Long.  Pogan, who was only eleven days on the job when this unfortunate incident occurred, has already had to resign from the force.  Hopefully his future holds only a career change instead of a criminal conviction for assault. </p>
<p>Pogan’s criminal defense attorney could use Pogan’s lack of experience to his advantage to reduce the assault charges and show that Pogan used bodily force as a form of self defense. Pogan asserts that he was originally attempting to detain Mr. Long because Long was riding with no hands, through a red light, in the middle of the street.  Unfortunately for Long, the video of the alleged assault shows many other bicyclists doing the same thing.  So what made Pogan single out Long?  Pogan has testified that Long at first appeared to be evading Pogan, but when their trajectories started to cross, Pogan believed that Long was going to try to knock him over by riding through him.  To protect himself, Pogan preemptively knocked Long off his bike before he was knocked over by the cyclist.  Pogan could have made a rookie mistake and miscalculated Long’s intent, or he could have correctly interpreted the situation and taken the best course of action that he could in the moment.  Either way, being charged with assault seems to be a drastic consequence.  As his criminal defense lawyer should point out, everyone knows that you will make mistakes when starting a new job and that it takes experience to do a job perfectly. </p>

			<content:encoded><![CDATA[<p>A <a href="http://www.criminalattorneyusa.com/michigan/" rel="nofollow" >Michigan</a> state based militia known as the Hutaree have made a big splash in the headlines following criminal allegations that they were staging an attack against police.  Nine members of the Hutaree militia have been charged by a federal court with seditious conspiracy, attempted use of weapons of mass destruction, and teaching the use of explosive materials and possessing a firearm during a <a href="http://www.criminalattorneyusa.com/violent-criminal-attorneys.aspx" rel="nofollow" >crime of violence</a>.  At first look, the decision to plead not guilty appears futile, since federal officials have substantial evidence against the militia members including voice recordings, intelligence gathered by an undercover agent, and 300 pieces of physical evidence seized with a search warrant including explosives, firearms, and bomb parts.  However, on closer examination, the <a href="http://www.criminalattorneyusa.com/criminal-defense-lawyers.aspx" rel="nofollow" >criminal defense attorneys</a>’ tactics are well substantiated by both the law and historical precedent. It seems like their federal attorneys have a game plan.</p>
<p>To begin with, the United States federal government has never won a seditious conspiracy case, conspiracy with aim to overthrow or destroy the state, against a right wing group.  Leonard Zeskind, author of Blood and Politics: The History of the White Nationalist Movement from the Margins to the Mainstreams writes that in order for the prosecution to prove seditious conspiracy they need more than “wild talk and gun charges” and must prove that Hutaree militia members had “imminent plans to cross the line from speech to sedition”(<a href="http://www.huffingtonpost.com/leonard-zeskind/strongthe-hutaree-militia_b_519066.html" rel="nofollow"  target="_blank">http://www.huffingtonpost.com/leonard-zeskind/strongthe-hutaree-militia_b_519066.html</a>).   The <a href="http://www.criminalattorneyusa.com/criminal-defense-lawyers.aspx" rel="nofollow"  target="_blank">federal defense attorneys</a> representing the nine members state that no crime was committed and that their clients were only exercising their right to free speech and assembly, including the right to dissent from the government.  The defense has already further gained ground by complaining that they have not been allowed to cross examine the undercover agent who collected much of the evidence against the alleged federal conspirators. </p>
<p>Past precedent in cases of seditious conspiracy shows that in order for the prosecution to win, they will need witnesses that are extremely credible and believable to the <a href="http://www.criminalattorneyusa.com/michigan/" rel="nofollow" >Michigan</a> jurors.  Author Leonard Zeskind reminds us it is not a crime in itself to be a “conspiracy besotted gun nut.”  One of the criminal defense lawyers for this case himself is arguing that “all you got is a lot of talk from people who like to dress up in fatigues and carry around guns in the woods.” </p>
<p>Will the jury find that the nine Hutaree are nothing more than gun totting, boy scout types talking a little smack against the federal government, or will they see them as domestic <a href="http://www.criminalattorneyusa.com/terrorist-threats.aspx" rel="nofollow" >terrorists</a> with serious intentions to use violence against the state?  In previous trials of seditious conspiracy against right wing groups, jurors have been much more sympathetic with the defense than the prosecution. However, what is novel about this case is that the Hutaree have made statements that they planned on specifically targeting police and their families.  Attacks against police are taken very seriously in this country and <a href="http://www.criminalattorneyusa.com/assault-battery.aspx" rel="nofollow" >assault and battery</a> of a police officer usually carries a greater punishment.  While jurors may be sympathetic against fellow compatriots conspiring against Uncle Sam, planning to attack police officers that work to protect us every day may have crossed the line from to conspicuous to seditious.<br />

The latest statistics show there were more than 35,000 reported crimes on U.S. college campuses in just one year.</p>
<p>Last month, a UCLA student was <a href="http://www.criminalattorneyusa.com/assault-battery.aspx" rel="nofollow" >assaulted</a>, getting stabbed several times and slashed in the neck by her organic chemistry lab partner. While the suspect was not known for having any history of committing <a href="http://www.criminalattorneyusa.com/violent-criminal-attorneys.aspx" rel="nofollow" >violent crimes</a>, school officials and law enforcement authorities speculate that the crime was committed after the suspect had a break-down from the stress of the class. An organic chemistry TA noted that the lab portion of the class was extremely difficult, KTLA reported. A man brandishing a gun held the school principal hostage for approximately 2 hours before the stand-off ended without any injuries. The initial police reports indicated that the gunman was a parent of a student who was recently suspended by the principal. This is just another example that demonstrates just how dangerous our school campuses really are. Any crime on school campus is considered a serious crime now, more than ever. Because of the recent events that have unfolded on campuses, courts are prosecuting these crimes aggressively, and it is vital to have a <a href="http://www.criminalattorneyusa.com/criminal-defense-services.aspx" rel="nofollow" >criminal defense lawyer</a> on your side to fight back and ensure you are not being taken advantage of.</p>

Some schools, however, insist they take adequate precautions to ensure their students&#8217; safety, including the use of patrols and guards. <p>There does not seem to be an ideal model for security and safety on school campuses across America. Perhaps, over time, school officials, government legislators and the general public will finally sit down to implement a system that is both effective and efficient.</p>
