When a person is facing criminal charges, he/she has an opportunity to plea in court. The defendant can plead guilty, not guilty, or no contest against the criminal charges he/she is facing. Before you enter your plea in court, one should speak with a criminal defense attorney. That’s because in many situations, a small gesture from one person to another can lead into an escalating argument and perhaps some people interpret a gesture as meaning one thing when really it means something else. Speaking with a criminal lawyer will help avoid that from happening. For example, sticking your thumb out means good job in one culture while in others, it has the complete opposite meaning. I am writing about this because of what I recently read in the news. Police officers say a road rage occurred between two people when a man made an obscene gesture to his neighbor. After the road rage, a fight broke out between the two neighbors. One of the neighbor’s father came out with a sword to protect his son. Authorities say 52 year old Joseph Lisco Sr. came out of his house with a sword to intervene! How far would you go to protect your son if you see him getting hurt? Sometimes people have the need to feel that they must do whatever it takes to protect their kids. Joseph should speak with criminal attorney to fight for the best outcome possible in his case. Joseph feared his son was seriously getting injured so he decided to act out to save his life. He managed to rescue his son from the fight but had to use his sword in order to do so. Now Joseph is being held on $50,000 bail. When police asked him why he did it, the 52 year old mentioned that he was defending his son. That indeed he was! But with a sword? Was that too much? Going too far? His criminal defense lawyers will need show that it was not, under the circumstances. We shall see how this one turns out…

Usually, children do not have a choice when deciding what home they are brought up in. Their parents have multiple years to teach them right from wrong. Their parents have plenty of time to teach their child what they believe in. Imagine being raised in a house that has been imbedded with Nazi signs and propaganda from the time you were a baby until you were 14 years old. How do you think you would turn out? People would like to believe that human beings know right from wrong naturally, and outside forces do not impact our capability to know the difference. That can be true for some cases but be false in others. Every situation is different. Criminal cases are very fact specific and it is up to a strong willed criminal defense attorney to not only show, but prove that in some cases, people can be severely influenced by outside forces to believe in something, even though it is known to others as being completely wrong. In southern California, a teen driven by white supremacist beliefs murdered one of his classmates at his high school because he was gay. The teen murdered his gay classmate by firing two gunshots to the back of his head. The district attorney says the teen defendant took action because of his white supremacist ideology that homosexuality is wrong. The criminal defense lawyer for the defendant argues that the defendant reached an emotional breaking point over constantly unwanted sexual advances by the victim and should be convicted for voluntary manslaughter. The defendant, who was 14 years old at the time of the shooting, is charged with murder, hate crime, lying in wait, and is being tried as an adult. A tough case for any criminal lawyer. Witnesses say the defendant brought a hand gun to school and sat behind the victim while he was sitting at a computer station. The defendant shot the victim once, then shot him again, inches away from his head. The criminal defense attorney says the victim would constantly sexually harass boys starting from when he was in fifth grade. The victim was suspended in fifth grade for this behavior. Hate crime cases are extremely tough for even the best criminal defense attorneys. These types of cases can carry a punishment up to life in prison or the death penalty depending on a few things. The criminal defense lawyer and the prosecution will both have a lot on their plates considering the high level of emotion involved with age of the victim and the age of the defendant.

Imagine getting into an argument with your mother one moment, then being in a gun battle with police officers the next. That’s the case for a man from Pittsburgh who murdered three officers in April of 2009, right after he got into an argument with his mother over his puppies urinating on the floor. Richard fatally shot three police officers and injured two others. He is described as a man who is enthusiastic, easy going, and a fun loving guy. How is it that someone who is described as these characteristics is being accused of such violent crimes? That’s a question for his criminal defense attorney to determine. No decision regarding a legal matter should be made without careful consideration and consultation with private counsel. If he hires a criminal defense lawyer right away, he will have strong partners who will defend him and try to attain him the best outcome given the circumstances. Unfortunately Richard Poplawski was represented by a public defender and was been convicted by the jury of three counts of first degree murder. The jury has imposed the death penalty on Robert Poplawsi. His first mistake was that he stuck to a public defender. Although they are great attorneys and very good at what they do, most of the time, public defenders are just too busy. Any criminal defense lawyer taking on this case would have a hell of a time putting together a strong defense but sticking with a public defender when so much is at stake might not have been the best idea in the world.

Hate crimes are one of the harshest crimes a human can be charged with. A hate crime is a crime motivated by bias towards sexual orientation, ethnicity, and race. Cases that involve hate can carry a punishment up to life in prison or the death penalty depending on how cruel the nature of the crime is. Six teenagers in New York City have been charged with murder and the reason behind their actions is hate. The teenagers decided to assault and murder a man because he appeared to be homosexual. Authorities indicted these teenagers with 21 counts including second degree murder as a hate crime. According to witnesses, the teenagers beat and stomped the 18 year old until he was dead. It will be tough for criminal defense attorneys to defend this case. Hate crimes are taken very seriously because it is a crime that clearly shows the intent behind the action. The criminal defense lawyers needs to prove to the court that the murder did not happen because the individuals have hate towards homosexuals. Any criminal defense lawyer taking on this case would have a hell of a time putting together a strong defense. The criminal lawyer that represents these defendants should be prepared for an uphill battle.

Imagine pushing a trash can down the street, then being investigated and arrested for what’s inside the trash can. In Ontario, California a woman was arrested because she was pushing a trash can down a street that contained remains of a human body. 51 year old Carmen Montenegro was pushing a trash can that smelled so terrible, it caused people to call the authorities. When authorities looked inside the trash can they discovered the remains of a man. Investigators are looking into who the remains are, what happened, and how it happened. Montenegro is in need of a great criminal defense attorney before charges are filed. If she hires a criminal defense lawyer right away, she will have strong partners who will defend and fight for her. She is in the Pre-file investigation stage of the criminal process. Millions of people throw out garbage everyday and it could have been anyone who placed the remains in that specific trash can. The first intent is to think that the trash can is filled with trash and not human remains. A criminal defense attorney is aware that these accusations can be taken out of context without explanation. That is why a criminal lawyer is necessary to show her side of the story in order to prevent charges from being filed. Criminal defense lawyers will come together and think of a game plan that will prevent charges from being filed.

The terrorist attack of September 11th is a defining point in American history and marked the beginning of the international, American-lead War on Terror. Terrorism crimes including terrorist threats or terrorist conspiracy are taken extremely seriously and can result in federal criminal charges and incarceration. Since 2009, more than twenty-five United States citizens have been charged with terrorism crimes and tried in a criminal court. In many cases, a criminal defense attorney has aided the alleged perpetrator in bargaining for a plea deal that has included a reduced sentence in exchange for cooperation and intelligence.

Terrorist networks are so frightening because they span international borders and do not fall under the control of any nation-state. This makes them unpredictable and difficult to pinpoint and combat. A member of a terrorist organization such as Al-Qaeda can be a hardworking, everyday citizen by day and an Al-Qaeda informant or operative by night. For example, Khalid Quazzani, a naturalized United States citizen was charged with money laundering, bank fraud charges, and sending $23,000 to Al-Qaeda. The criminal lawyer for Mr. Quazzani has negotiated a plea deal for Mr. Quazzani in exchange for statements regarding Mr. Quazzani’s involvement in the Al-Qaeda terrorist organization. Mr. Quazzani could be sentenced to sixty-five years in federal prison without parole and a fine of up to $1 million dollars. Al-Qaeda ranks on the United State’s top list of threats to National Security. As Mr. Quazzani’s sentence shows, any act of support for Al Qaeda or any other terrorist organization, financial or otherwise, is treated as a threat to our nation.

In another recent case Syed Hashmi has been tried for conspiracy on federal terrorism charges for conspiring to provide Al-Qaeda with “military gear” and loaning a $300 to purchase a plane ticket to transport the alleged gear to Pakistan. The “military gear” included items such as sleeping bags, ponchos, and waterproof socks destined for Al-Qaeda use in Afghanistan. Hashmi’s skilled criminal lawyer fought aggressively and negotiated a plea deal that reduced Hashmi’s sentence from a possible life sentence to fifteen years in prison. Mr. Hashmi could be released in ten years for good behavior at the soonest and has already been in custody pending trial for four years.

The most recent case of attempted terrorism is the attempted car bomb in New York’s Times Square. Faisal Shahzad, the alleged perpetrator, has become the face of domestic terrorism, receiving high media coverage due to the severity of the federal attempted terrorism charges and his unabashed demeanor regarding his actions. Shahzad was arraigned in federal court on charges of attempted murder, attempted use of a weapon of mass destruction, using a destructive device with an attempted crime of violence, and transporting explosives. If convicted of attempted terrorism, Shahzad could be sentenced to life in prison. Shahzad’s federal lawyer has until the next court date in June to decide what the best course of action will be for Shahzad’s case in order to reduce the maximum jail sentence. The plea deal will likely depend on whether Shahzad is found to be an individual actor or part of a greater terrorist plot, and whether he can be and/or is willing to be an informant for uncovering a larger terrorist network.

Federal terrorism charges are some of the most serious charges that an individual can face and require a skilled federal defense attorney. The federal government is still refining how to handle terrorist crimes including terrorist threats and attempted terrorism. Some people argue that the criminal justice system is successful in managing terrorism cases while others believe that terrorism cases are best managed by the military in military court. It is very possible that the criminal justice system in the future may not only be used to try United States nationals who are charged with terrorist threats or attempted terrorism but also non-Americans who have been found to be a threat to national security such as the Guantanamo Bay detainees.

Criminal justice is about intent and result. If you kill a person, the punishment depends on whether the act was premeditated, spontaneous, or self-defense. If you are caught selling drugs, it matters if you are a juvenile or an adult and are perceived by the court to understand the full consequences and meanings of your actions. In our criminal justice system it is the role of the criminal defense lawyer to show the court the intention behind the crime and seek an appropriate consequence for the crime committed. It is said that many crimes are motivated by greed, jealousy, or lust. However, human motivation is not always so simple, or so malevolent. In many cases, a criminal lawyer is able to explain the mitigating circumstances such as need, addiction, or depression that causes a person to commit a crime. For example a father does not steal baby formula because he is greedy, but because he desperately needs to feed his child.

However, certain crimes are so heinous that it is difficult to conceive of any justification or imagine the motivation behind the crime. For example, what causes a person to mark a mentally disabled man with degrading symbols, drag a black man behind a truck until all remnants of life have been torn from his body, or beat a South American immigrant to death because it appeared that he was gay? Hate crimes are a special class of criminal charges differentiated by the intention behind the crime. A hate crime is a crime motivated by bias towards ethnicity, race, religion, sexual orientation, or disability. Hate crimes are often punished by a harsher sentence than the same criminal action not motivated by these biases. Hate crime cases are extremely tough for even the best criminal defense attorneys and can carry a punishment up to life in prison or the death penalty depending on the severity of the crime.

For example, in a recent case three New Mexico men have been accused of kidnapping, branding a swastika, cutting a swastika into the hair, and writing degrading messages all over a mentally challenged man from the Navajo reservation. The men have been charged with kidnapping, aggravated battery, and causing great bodily harm. They are already facing felony charges, but prosecutors are also going to fight aggressively for these men to be charged with a hate crime. If convicted of a hate crime, New Mexico law mandates that one year will be added to the sentence for each charge that they are convicted of. The alleged perpetrators could receive up to thirty-five years in prison, including eighteen years of incarceration without consideration for parole. These men will need an experienced criminal attorney to repudiate the hate crime allegations or they could be spending more than a third of their life in prison.

Is this case a hate crime? The most grievous allegation against the three men is that they allegedly branded a swastika on the mentally disabled man’s arm using a heated metal clothes hanger. However, branding itself is not always a crime, much less a hate crime. A man was recently acquitted of two counts of branding his children in Washington State. Once again it is all about intent. The Washington man was acquitted of the assault charges against his children because his criminal defense attorney proved to the court that the branding was not done out of anger or cruelty but was a manner in which the family bonded and demonstrated family unity. However, given the historic symbolism of the swastika, the ethnic background, and mental disability of the victim, it is unlikely that even a skilled criminal lawyer will be able to dismiss all charges against these men. The criminal defense lawyer on this case will have a challenge to even rebuff the hate crime enhancement to the kidnapping and assault charges. During a search following the alleged incident, police found insignia associated with white supremacists, which is one of the foremost groups to be charged with hate crimes. The best course of action for these men and their criminal defense lawyer could be to negotiate a plea deal since a jury is most likely going to be very unsympathetic towards men with white supremacist sympathies that branded a Nazi associated symbol on a disabled man that could not defend himself.

Animals with high testosterone levels are known to be fearless fighters and the ultimate predators. The African lions of Tsavo National Park in Kenya are reputed to be the most aggressive lions in the world. Why? Scientists believe that the higher testosterone levels in this particular group of lions makes them more aggressive and territorial than any other pride. In sharks, species with the highest testosterone levels are the most aggressive sharks in the ocean, more aggressive even than the great white. Testosterone levels between species vary but testosterone levels between individuals of the same species, including humans, also vary. Are some men naturally predisposed to violence and incapacitated by their chemical makeup when it comes to controlling their anger and aggression? Are certain men in greater danger of becoming involved in a domestic dispute and being charged with domestic violence? Do the men represented by domestic violence attorneys have higher testosterone levels than other men who were never charged with spousal battery? While these questions of yet have no concrete answers, a recent domestic violence case shows that there could be some validity to the hypothesis that men charged with domestic violence could suffer from above average testosterone levels.

Tito Ortiz has been arrested on charges of domestic violence. He has been accused of assaulting and beating his girlfriend Jenna Jameson in their home in California. For those of you who do not know who Tito Ortiz is, he is a 6-foot-3, 205 pound Ultimate Fighting Champion. This is a man who has made fighting his life passion and work, and who has had considerable success by being strong, aggressive, and fearless. Ortiz could very probably have higher than average testosterone levels, a chemical imbalance that has been shown to make many men pursue greater risk taking activity and may as in other species lead to greater aggression. This will be a challenging case for the criminal defense attorney representing Ortiz. Jameson allegedly sustained visible injuries after the alleged attack by Ortiz and it is likely that Ortiz will be charged with felony domestic violence. The domestic violence attorney representing Ortiz will have to put up a solid defense in order for Ortiz to retain parental rights of his children and not become convicted and labeled as a spouse beater. If Ortiz indeed does suffer from genetically high testosterone levels, is this a fact that can be used in his defense? In many cases physical and mental medical conditions such as Depression, Attention Deficit Disorder, and Post Traumatic Stress Syndrome that affect impulse control are used by criminal defense attorneys to show that their clients could not control their criminal actions. Ortiz’s domestic violence lawyer should investigate Ortiz’s testosterone levels and if they are higher than average use this as a defense to mitigate felony charges of domestic violence. If in fact Ortiz faces a greater challenge in controlling anger and aggression, he will need anger management courses and perhaps hormone therapy, not time behind bars.

How would you like your transgression to be viewed by millions of people on the web? Former NYPD officer Patrick Pogan, who is accused of assaulting cyclist Christopher Long during a Critical Mass ride, has to face being a YouTube sensation every day. In a video that has been viewed over two million times, the infamous officer appears to slam Long off his bike for no reason that is apparent to the viewer. Pogan faces up to four years of prison time if convicted of charges against him including assault and falsifying a report. His criminal defense lawyer will have to prove that Pogan had reason to forcefully detain the cyclist and that he did not intentionally change his story in his initial police reports of the incident to falsely incriminate Long. Pogan, who was only eleven days on the job when this unfortunate incident occurred, has already had to resign from the force. Hopefully his future holds only a career change instead of a criminal conviction for assault.

Pogan’s criminal defense attorney could use Pogan’s lack of experience to his advantage to reduce the assault charges and show that Pogan used bodily force as a form of self defense. Pogan asserts that he was originally attempting to detain Mr. Long because Long was riding with no hands, through a red light, in the middle of the street. Unfortunately for Long, the video of the alleged assault shows many other bicyclists doing the same thing. So what made Pogan single out Long? Pogan has testified that Long at first appeared to be evading Pogan, but when their trajectories started to cross, Pogan believed that Long was going to try to knock him over by riding through him. To protect himself, Pogan preemptively knocked Long off his bike before he was knocked over by the cyclist. Pogan could have made a rookie mistake and miscalculated Long’s intent, or he could have correctly interpreted the situation and taken the best course of action that he could in the moment. Either way, being charged with assault seems to be a drastic consequence. As his criminal defense lawyer should point out, everyone knows that you will make mistakes when starting a new job and that it takes experience to do a job perfectly.

As for the charges of falsifying business records and making false accusations, Pogan’s criminal defense lawyer will need to prove that Pogan did not mean to make conflicting statements but was caught up in the heat of the moment, probably had an adrenaline rush, and did not remember the altercation very clearly afterwards because it all happened so fast. Mr. Pogan is an upstanding citizen and prior to becoming a police officer had worked as an emergency medical technician. Although this incident and the YouTube video has demonized Mr. Pogan into an attack cop, hopefully his criminal defense attorney will be able to vindicate Mr. Pogan against his assault charges and show that he is still a good man to have around in an emergency.

A Michigan state based militia known as the Hutaree have made a big splash in the headlines following criminal allegations that they were staging an attack against police. Nine members of the Hutaree militia have been charged by a federal court with seditious conspiracy, attempted use of weapons of mass destruction, and teaching the use of explosive materials and possessing a firearm during a crime of violence. At first look, the decision to plead not guilty appears futile, since federal officials have substantial evidence against the militia members including voice recordings, intelligence gathered by an undercover agent, and 300 pieces of physical evidence seized with a search warrant including explosives, firearms, and bomb parts. However, on closer examination, the criminal defense attorneys’ tactics are well substantiated by both the law and historical precedent. It seems like their federal attorneys have a game plan.

To begin with, the United States federal government has never won a seditious conspiracy case, conspiracy with aim to overthrow or destroy the state, against a right wing group. Leonard Zeskind, author of Blood and Politics: The History of the White Nationalist Movement from the Margins to the Mainstreams writes that in order for the prosecution to prove seditious conspiracy they need more than “wild talk and gun charges” and must prove that Hutaree militia members had “imminent plans to cross the line from speech to sedition”(http://www.huffingtonpost.com/leonard-zeskind/strongthe-hutaree-militia_b_519066.html). The federal defense attorneys representing the nine members state that no crime was committed and that their clients were only exercising their right to free speech and assembly, including the right to dissent from the government. The defense has already further gained ground by complaining that they have not been allowed to cross examine the undercover agent who collected much of the evidence against the alleged federal conspirators.

Past precedent in cases of seditious conspiracy shows that in order for the prosecution to win, they will need witnesses that are extremely credible and believable to the Michigan jurors. Author Leonard Zeskind reminds us it is not a crime in itself to be a “conspiracy besotted gun nut.” One of the criminal defense lawyers for this case himself is arguing that “all you got is a lot of talk from people who like to dress up in fatigues and carry around guns in the woods.”

Will the jury find that the nine Hutaree are nothing more than gun totting, boy scout types talking a little smack against the federal government, or will they see them as domestic terrorists with serious intentions to use violence against the state? In previous trials of seditious conspiracy against right wing groups, jurors have been much more sympathetic with the defense than the prosecution. However, what is novel about this case is that the Hutaree have made statements that they planned on specifically targeting police and their families. Attacks against police are taken very seriously in this country and assault and battery of a police officer usually carries a greater punishment. While jurors may be sympathetic against fellow compatriots conspiring against Uncle Sam, planning to attack police officers that work to protect us every day may have crossed the line from to conspicuous to seditious.
